Can officers use privately owned BWC’s?
No, under no circumstances may a privately owned BWC be utilized.
Officers will activate the BWC under what circumstances?
- Vehicle stops
- Person stops
- All dispatched calls for service
- Detentions and investigations, including post Miranda interrogation
- Search incident to arrest
- Search warrants of vehicles or structures
- K9 searches requested by patrol
- As soon as possible after officer involved collision
- Code 3 driving
- Pursuits: primary and secondary officers
- Any contact that becomes adversarial
- Transport of Code 5 prisoners
- Any other citizen contact or official duty circumstance at the officer’s discretion
Are officers required to obtain consent prior to filming with a BWC?
No.
What documents should the existence of a BWC be documented?
All reports
How can citizens review the body camera footage?
- They will not be allowed to view the footage in the field.
- Citizens will be advised to refer to the procedure on lvmpd.com
- or call BWC Dissemination Manager
How should supervisors utilize officers with BWC on major scenes?
-They should be deployed as necessary to meet tactical requirements.
If it is safe and practical, BWC officers can also be used to document key activities
Following an OIS, when can body camera footage be reviewed?
- Nobody (officer or supervisor) WILL NOT view the footage prior to FIT/CIRT/IAB viewing the footage
- Involved officers can view their own footage prior to a walk-through and statement
- Witness officers can view their own footage prior to a walk-through and statement
- If exigent circumstances exist (officer is injured, need suspect description) BWC footage can be watched
