Supervisors responsibility for maintain department values
-Assist employees in understanding the departments ethical standards
During the first quarter
-ensure agency values are discussed in a formal session
-review the oath of office
-review law enforcement code of ethics
Conduct ICARE training
Review EIIP dashboard on a monthly basis
Ensure commendable actions given at bureau level are entered into IA Pro system
Burden of proof for Internal Investigations

- Conducted to determine the nature of the complaint

Customer service dispute
- Disputes concerning the methods and procedures used by the department

- Explaining/educating the complainant as to the operations of the department as well as improving service delivery
- Not an allegation that involves a violation of department policy or law
Minor allegation investigation
- Allegations of misconduct
- If found to be true would result in discipline
- Ranging from written reprimand to suspension of less than 40 hours, or disciplinary transfer
Major allegation investigation
-Allegations of misconduct
-If found to be true would result in discipline
-Suspension of 40 hours, demotion, or termination
All such cases are investigated by IAB unless sheriff or designee directs otherwise
Internal investigation findings
Sustained
-investigation established misconduct occurred
Not Sustained
-Investigation failed to produce sufficient evidence to clearly prove or disprove allegation
Unfounded
-complaint of conduct did not occur
Exonerated
-the act did occur, but was justified, legal, and proper
Misconduct not based on complaint
-misconduct occurred which was not based on original complaint
Policy failure
- the act did occur, and was in compliance with policy.
- allegation of misconduct could have been prevented had policy been more clear or complete
Supervisor receiving or initiating a complaint will interview the complainant and document what?
- Nature of the complaint
- Person making complaint
- Any witnesses
- Supervisor will advise that if there is any missing/incomplete information there may be a delay in completing the investigation
- Explain the investigatory process to the complainant
What does a supervisor do when a complaint (SOC) is completed
-Forward completed SOC to IA
If a person insists on making a complaint, and the allegation does not meet misconduct in the supervisor’s estimation, what must be done?
- A SOC will be completed
- SOC will be forwarded to IA for review and conclusion
What allegations can be investigated by the Bureau/Area Commander?
Minor allegations
Complaints of harassment or discrimination may be reported to who?
- Any supervisor
