What is clear initiative

What does CLEAR stand for
C- collisions L- lead E- evaluation A- act R- reopen
Explain CLEAR
Collision and other incidents can close carriageway lanes which adversely affects the economy
Effective leadership needs to be established to co- ordinate the incident response
Understand the scale of the incident ensures a proportionate response
All incident responders act in partnership, recognising and respecting differing organisational priorities
The carriageway lanes are re-opened ASAP to reduce the impact of incident closures on road users and the economy
Section 170 (1) road traffic act 1988
Owing to the presence of a mechanically propelled vehicle ( MPV on a road or other public place, an accident occurs whereby; personal injury is caused to a person ( other than the driver of that MPV)
Or
Damage is caused to:
A vehicle (other than the MPV or any trailer drawn by it)
Or
An animal (other than one in or on that MPV or any trailer drawn by it)
Or
Any other property, constructed on, fixed to, growing in or otherwise forming part of the land on which the road or other place in question is situated or land adjacent to such land
What is owing to the presence
The incident must have been as a result of mechanist propelled vehicle (MPV) being present at the scene
What is a vehicle
A vehicle is any kind of carriage or conveyance and includes
Coach, car, motorcycle, bicycle and horse drawn cart
What is MPV
A vehicle constructed so that it can be propelled mechanically
What is a motor vehicle
A mechanically propelled vehicle intended or adapted for use in road
What is SEPDOG
S- steam E- electricity P- petrol D- diesel O-oil G-gas
Road- what is section 192(1) of the road traffic act 1988
Any highway and any other road to which the public has access, and includes bridges over which a road passes
What is a highway?
The whole or part of a highway other than a ferry or waterway
Where a highway passes over bridge or through a tunnel, that bridge or tunnel is to be taken for the purposes of the act to be part of the highway
Carriageway- what is section 329 of the highway act 1980
A way constituting or comprised in a highway, being a way (other than cycle track) over which the public have a right of way for the passage of vehicles
What is a public place
Any place to which the public has access whether on payment or otherwise
What is a driver?
Includes a person who takes a vehicle out on a road and remains the driver until he/she finished their journey
A person can still be a driver even though they have stopped and switched off the engine
What is driving?
Means in control of the propulsion and steering of the vehicle

Section 170 road traffic act 1988- STOP
The driver must stop and remain at the scene long enough to allow any person having reasonable grounds to do so to ask for details

The driver must report it in person to a police officer or at a police station as soon as reasonably practicable or in any case within 24 hours
Fail to stop/report an accident- section 170(4) road traffic act 1988
A person who fails to comply with subsection 2 or 3 above is guilty of an offence

A person who fails to comply with a duty under subsection (5) is guilty of an offence, but he shall not be convicted by reason only of a failure to produce a certificate or other evidence if within seven days after the occurrence of the accident, the certificate or other evidence is produced at police station that was specified by him at the time when accident was reported
What is a motorcycle
A MPV other than an invalid carriage

What is a moped?
A motor vehicle which has fewer than four wheels
What is a motor car
Means a mechanically propelled vehicle not being a motorcycle, motor tractor or an invalid carriage, which is constructed itself to carry a load or passengers
What is a goods vehicles
A motor vehicle or trailer constructed or adapted for use for the carriage or haulage of goods or burden of any description
What is a passenger vehicle
A vehicle constructed solely for the carriage of passengers and their effects
What is a trailer?
A vehicle drawn by a motor vehicle
What is a semi trailer?
A vehicle which is constructed or adapted to form part of articulated vehicle

What is section 165A road traffic act 1988- seizure of vehicles
If any of the specified conditions are satisfied in relation to a vehicle a constable may
Seize the vehicle
Remove the vehicle
Enter any premises other than a private dwelling house on which he/she has reasonable grounds for believing the vehicle to be
Section 164 road traffic act 1988- HORT 1
If a Person cannot produce driving or vehicle documents at the time you should check PNC first if unable to
Issue them with the HO/RT 1 form which directs the driver to produce their driving documents to a police station within 7 days from midnight on the date of the stop
Section 164 road traffic act 1988
When the person produces the documents together with the form HO/RT 1 at the police station the officer or station officer records the required details on a form HO/RT 2
If offences are disclosed when the documents are produced at the police station the officer or station will report the person for the offence
Section 28A vehicle excise and registration act 1994 states that
A person using a vehicle in respect of which a registration document has been issued produce the documents for inspection on being so required by
A constable
A person authorised by the Secretary of State for the purposes of this section
A person is guilty of an offence if he fails to do so
Section 165
A constable in uniform has reasonable grounds to believe a motor vehicle is or was being driven with no insurance or no driving license/ driving otherwise than in accordance with a license or has failed to stop and there are reasonable grounds to believe the above then the vehicle is seized
