What is a psychoactive substances?
Formerly referred to as a legal high they are made from assorted herbs, herbal extracts and research chemicals
Define PSA 2016 ?
A substance capable of producing a psychoactive effect in a person who consumes it.
Name ways to consume?
Injection Smoking Drinking Snorting Inhaling
Section 4 producing PS
Intentionally produce a substance knowing or suspecting it to be PSA and intends to consume PSA for its psychoactive effects or knows/ reckless as to whether the PSA is likely to be consumed by some other person
Section 5, supply and offering to supply PS
Supply of a ps, offering to supply a PS, for supply must be PS and cover distribution, the transaction does not need to result in payment or reward and would include social between friends
Aggravated supply- section 6
In the Vicinity of school premises at a relevant time
When school premises are in use by person under 18 and this includes one hour before and after of any such time or courier was used by offender, who at the time of the offence was under 18 or committed whilst in a custodial institution
Section 36 PS act 2016- persons
Police officer has reasonable grounds to suspect that a person has committed or is likely to commit offences under section 4-9 or section 26 he may search the person for relevant evidence and stop and detain the person for the purpose of the search any place to which the officer lawfully has access
Section 37 PSA 2016- vehicle
Where a police or customs officer has reasonable grounds to suspect that there is relevant evidence in a vehicle he may at any time and in any place to which the offence lawfully has access enter the vehicle and search it for relevant evidence stop and detain the vehicle for the purposes of entering and searching it
Possession with intent to supply section 7
A person is in possession of a PS
The person knows or suspect that the substance is PS and
The person intents to supply the PS to another person for it consumption whether by any person to whom it is supplied or by some other person
