What are the rights of a person to make a complaint?
A person in custody wishing to make a complaint about the conduct of any person performing duties in connection with their detention must have all reasonable steps taken to ensure a complaint may be made.
A request must be complied with as soon as reasonably practicable but no interrupting the carrying out of other lawful procedures or functions.
What are the responsibilities of members who suspect corruption etc?
A member who suspects another has engaged in corrupt conduct, misconduct or mal administration or in public administration must report that suspicion.
Report it IIS or OPI ASAP, in the manner requested by IIS or oPI and comply with ICAC requirements.
What is obstruction of a complaint?
A person must not prevent another person from making a complaint or report under the act OR
Hinder or obstruct another person in making such a complaint
What are false/misleading statements?
A person must not make a statement knowing it to be false or misleading OR
Make a complain where there are no grounds to make a complaint
What information must be divulged?
Information obtained through course of investigation is not required to be disclosed unless:
- by ICAC/OPI
- in proceedings before a tribunal for an offence or breach of discipline
- royal commission
- order of the court
