What are the main differences between 125B LLA and 125A LLA?
125A relates to commissioner authority to bar a person for an indefinite period of time or specified period for:
Specific licensed premises
Licensed premises of a specified class
Licensed premises of a specified class within specified area
All licensed premises within a specified area
How are people barred by police officers?
125B LLA
Approved by substantive Sgt, OIC or boss
Barring period cannot exceed 72 hrs and applies only to single prems
When can a barring order be issued approved by Sgt?
- welfare of person or someone residing with person seriously at risk as a result of the consumption of alcohol
- Person has committed offence or behaved in an offensive or disorderly manner
- Any other reasonable grounds
Welfare grounds cannot exceed 72 hrs, up to three months for the rest as approved why a SGT
When may an OOP authorise a baring order?
- welfare of person or someone residing with person seriously at risk as a result of the consumption of alcohol
- Person has committed offence or behaved in an offensive or disorderly manner
- Any other reasonable grounds
Welfare grounds is not greater than 12 MO.
Others: first barring order <6 months, 2nd <6 months, 3rd and over <12 months
Where can an OOP bar a person from?
Specific licensed premises
Licensed premises of a specified class
Licensed premises of a specified class within a specified area
All licensed premises within a specified area
What must an issuing officer do?
Seek authorisation from appropriate officer
Complete barring paperwork
Specify the period to be barred and desc of prems;/area
Detailed notes
Personally serve the original barring ofer on the person
Provide a copy of the barring order to the licensee with 14 days
