When may a PO detain a person

A
  • PO BORG the person is a patient in respect of whom:
    • a patient assistance request or patient transfer request has been issued
  • PO BORG the person is a patient who is absent without leave; or
  • it appears to the pO that
    • the person has a mental illness
    • has caused or is risk of them causing harm to self or others or property and
    • require medical examination

What powers does a PO have under s57?

A
  • take person into their care and control
  • transport from place to place
  • restrain and use force reasonably required
  • enter and remain in a place where the officer reasonably suspects the patient to be
  • use reasonable force to break into a place that is required in order to take the person into their care and control
  • search persons clothing or possessions and take possession of anything they may use to cause harm
