What is a death in custody?
The death of a person where there is reason to believe the death occurred or the cause of death or possible cause of death, arose, or may have arisen while the person was:
- detained in any place within the state under any act or law, inc. home detention; or
- In the process of being apprehended at any place by authorised person under law
- Was evading apprehension by a person authorised to apprehend
- Escaping or attempting tp escape from any place or person in the state and authorised under law
What is a reportable death?
- unexpected, unnatural, unusual, violent or unknown
- On an aircraft in flight, vessel on a voyage
- In custody
- During or as a result or within 24 hrs of:
- A surgical procesure
- Administration of anaesthesia
- Within 24 hrs of:
- Having been discharged from a hospital or
- Having sought emergency treatment at a hospital
- The person was protected under aged or GOM Acts
- GOM
- Patient of approved treatment centre under the mHA
- Resident of a licenced supported residential facility
- Accommodated at hospital or other for drug addiction
- No certificate for cause of death has been given
What is a state death?
occurred in the state Place of death is unknown but possibly in the state Body is in the state Cause possibly occurred within the state Resident of the state Flight or voyage to the state
What is a Tier One death?
reportable deaths not within the criteria of tier 2 or 3. Involve investigation into the circumstances of deaths which are not complex and may be attributed to illness or unknown cause
What is a Tier Two death?
Suicide Drug OD Death of a child (under 18) Suspicious death Workplace accident Aviation Marine/drowning Railway fatality Significant other reportable Death in custody in non-correctional or non-police custody Death in department for CORRECTIONAL SERVICES (INCLUDING PALLIATIVE CARE)
What is a Tier Three death?
DCS prisoner in community palliative care
As allocated by the coroner to cis
aNY OTHER INCIDENT OR INVESTIGATION AS DIRECTED BY O/C MCIB
What are the exceptions to the Coronial Investigation Model?
- Deaths in police custody
- Significant incident investigation or Commissioner’s enquiry
- Homicide
- Major crash AMBIT
What are GD roles for Tier 1 Deaths?
Initial response CS preservation Completion of prelim coronial file Submission of prelim coronial file Supply to GD supervisor for vetting
What roles is the GD supervisor responsible for for tier one deaths?
ensure necessary resources available and coordinated
Collation and vetting of prelim coronial file
Electric transmission to CIS
What are GD roles for Tier 2 Deaths?
Initial response CS preservation Completion of prelim coronial file Submission of prelim coronial file Supply to GD supervisor for vetting Seek guidance from CIB in their non attendance
What roles is the GD supervisor responsible for for tier one deaths?
- ensure necessary resources available and coordinated
- Collation and vetting of prelim coronial file
- Electric transmission to CIS
What are the responsibilities of a member involved with a death in police custody?
immediately report to SSM through supervisor
- Circumstances leading to incident
- Deceased details
- Circumstances regarding apprehension and death
- Welfare of involved members
What are the responsibilities of members directly involved with a death in custody?
take all steps to preserve life and render assistance
Ensure member not involved takes control of the incident as forward commander
Secure scene
Liaise with most senior member not involved and ensure all relevant and accurate info is provided
Independent notes and statements while facts are fresh
What is the role of the PFC at the scene of a death in custody?
take control of incident
Establish CS and protect CS
Secure evidence
Segregate involved members
Ensure all members commence independent notes
Identify witnesses and organise statements
Organise patrol logs, running sheets etc
Ensure welfare of members attended to
Appoint independent person to assist in the comfort of members during post incident process
Ensure submission of relevant documentation
What authorities may you use to enter a premises?
- 83C(1) SOA - Senior police Officer authorises entry on the grounds an occupant has died and their body is on prems or in need of medical attention or other assistance
- 83C(3) - Commissioner or delegate can authorise entry to search premises in which person last resided before their death for ID deceased or relatives
- Delegate must be OOP and is O/C Forensice Services Branch, OC LSA, SSM and DDI
