What are the requirements to be detained under the MHA?
Must be suffering from a Mental Disorder
Must be at risk to self/others/health/self neglect or serious exploitation
Must be unwilling to go to hospital voluntarily
How many doctors required to detain under MHA?
Recommendations by two doctors, + 1AMHP (one of which must be “Section 12 approved”)
Is a learning disability a mental disorder?
No, unless ‘abnormally aggressive or seriously irresponsible conduct’
