Q

Describe negotiations

A

The main purpose of negotiation is for employers and employees to come to an agreement.
Good negotiations involve employees in the decision making process.
Both parties must understand that if negotiations are to be successful then they must compromise.
Industrial action can take place to force the employers to listen to TUs.

Q

Describe consultation

A

Employers under employment law must inform employees of changes they plan to make and why.
Employers should then listen to the views of the employees through their TU.
Employers are under no obligation to listen to the TU or take their opinion into account

Q

Describe arbitration

A

When no agreement takes place and a stalemate point is reached ACAS is called in to resolve the dispute.
ACAS is neutral and will listen to both sides of the dispute.
They will gather their own evidence.
ACAS will seek approval of the employees and employers to accept a final decision made by ACAS – if they agree this is called ARBITRATION.
If they don’t agree negotiations will continue.
Industrial action may also take place.
