What is the difference between drunkness and alcohol intoxication?

A

The former you can not measure it, meanwhile the latter you can.
You may be intoxicated with alcohol and not show any drunkness symptoms, or vice versa.

Who can receive alcohol control?

A

A driver of a vehicle or driving an animal in a public space.
The companion of a learner driver.
Anyone involved in a traffic accident (driver, suspect, and pedestrians if involved).
A passenger or a pedestrian is not obliged to alcohol control.

What is the breath test?

A

To determine the level of alcohol in the alveolar breath.
You must blow an instrument for 7 seconds to determine the level of intoxication. However, this is not legal proof.
The legal proves is the breath analysis or a blood test.

Can you claim to wait before the breath test is carried?

A

Yes. You have the right to wait 15 mins (especially if you just had a drink).

What are the possible results from the test?

A

S: safe or secure. The level of alcohol is below the limit.
A: alarm. Positive, your level is AT LEAST 0.2 mg/litter (0.5 promile) but below 0.35 mg/L (0.8 promile).
Then you need to take a breath analysis.
P: positive. The alcohol level detected is a minimum of 0.35 mg/L (0.8 promile).

A

You will be considered positive and will be banned from driving for 6 hours.

What is the breath analysis?

A

By means of the exhaled alveolar breath, the exact level of alcohol can be determined.
The device prints a tkts and you get a copy.
Less than 0.22 mg/l, you may drive on.
Between 0.22 and 0.35 mg/l: you have to hand in the driving license, you must wait 3 hours and pay a fine.
Above 0.35 mg/l: you have to hand in the driving license, you must wait 6 hours and pay a fine. Your license can be suspended inmediately. After 6 hours another breath test is carried.

What is a drug test?

A

A swab test to determine the level of certain drugs.
If you exceed the limit of certain drugs, you must hand in your driving license, wait 12 hours and make again the saliva test.
Your driving license can be suspended inmediately.

What is recidivism?

A

When a driver within a period of 3 years from the previous offense, makes again another listed:
Driving drunk, or with drugs.
Hit and run
Driving without a license.
Category 4 traffic offenses.
More than 40 or 30 kph within a built-up area.
The use of radar detectors.
The judge will have to ban the right of driving, make the exams again, and make a physical and psychological test.

What is an alcohol lock?

A

The judge can decide to replace the disqualification from driving with an alcohol lock.
If the offender commits 2 new offenses, he gets 6 months of a lock.
With 3 new offenses, he gets 9 months of a lock.
