Enforcement Agency For ESBs if facility is not owned by the State of CA per Section 16009;

Preparation of Drawings per Section 16015;
-All drawings and specifications shall be prepared under the responsible charge of an architect, civil engineer, or structural engineer, who shall sign all drawings and
specifications for approval of the enforcement agency.
-Observation of the work of construction shall be under the responsible charge of the same architect, civil engineer, or structural engineer, unless work does not involve
architectural or structural conditions.
-If work does not involve architectural or structural conditions, drawings and specifications may be prepared by a registered professional engineer qualified in the
type of engineering that is appropriate to the drawings and specifications, and work of construction.
Inspections provided BV Owner During Construction per Section 16017
- The Building Owner shall provide for, and the local enforcement agency shall require, competent, adequate, and detailed inspection by a qualified inspector.
- To be qualified, inspectors shall have an adequate level of expertise and experience in the subject matter for which they have responsibilities for inspection.
- Qualification shall include current certification by the International Conference of Building Officials or meet qualifications according to the International Building Code.
Periodic Review of Construction per Sections 16020 and 16021
During construction, the architect, civil engineer, or structural engineer in general responsible charge of the work of construction, and the registered engineer shall
make a report, verified by him/her through periodic review of construction, showing the work during the period covered by the report has been performed and that the materials used and installed are in accordance with drawings and specifications.

Periodically, as the work progresses, the Inspector of the work (hired by the Owner) and the Contractor shall each make a report, verified by him/her showing in his own
personal knowledge, that the work has been performed and materials installed in accordance with drawings and specifications.

Summary of Duties During Construction
- Architect must perform periodic review of construction (Contract Administration), prepare reports for submittal to the enforcement agency, and review reports prepared by others
- Owner must hire a qualified inspector who will prepare reports for submittal to the enforcement agency and review reports by others
- General Contractor must prepare reports for submittal to the enforcement agency and review reports by others
The Division of the State Architect shall do all of the following per Section 16022
- Observe the implementation and administration of the Essential Services Buildings Seismic Safety Act.
- Establish and adopt, in consultation with the League of Cities, County Supervisors Association, and California Building Officials, those regulations deemed necessary for carrying out the Essential Services Buildings Seismic Safety Act.
- Provide advice and assistance to local jurisdictions regarding essential services buildings.
- Hear appeals relative to the administration of the Essential Services Buildings Seismic Safety Act.
Responsibility for enforcement of the ESBSSA falls to …
1) …the local building jurisdiction for locally owned or leased facilities
and
2)…the Division of the State Architect (DSA) for state owned or leased facilities.
