Signed just by the CO
When is a unilateral modification appropriate?
administrative changes, issue change orders, issue other changes authorized by contract clauses other than changes clause.
What is a bilateral modifications?
SIgned by both parties
When is a bilateral modification appropriate?
Negotiate Equitable adjustments, definitize letter contracts, reflect other agreeements of the parties that change the contract.
Changes clause for fixed price allows what?
changes within scope to be done unilaterally.
What happens if CO issues a change order?
contractor may request an equitable adjustment to Cost, profit/fee, and delivery schedule, or both.
When is notification of changes clause appropriate?
clause used in contract over $1M
WHat does the Notification of Changes clause state?
KTR must notify CO within a specified number of days if he believes the contract has been changed without direction from the O>
What must CO do if notified by KTR under Notification of Changes clause?
CO must respond within specified number of days with on of the following:
Confirm the change and direct KTR to continue and arrange for funding
Countermand any communication regarded as a change
Deny that change has occurred and direct KTR to continue performance
What must a KTR do with requesting an Equitable Adjustment?
KTR must provide information supporting REA (Rationale and data)
What happens if the REA is > SAT?
KTR must certify the REA is made in good faith, accurate, and complete.
When is Release of Claims Language required?
in all modifications that definitze change orders.
What can you change for supplies in the changes clause?
Change in drawings, designs, and specs
Change method of shipment/packing
Change palce of delivery
What can you change for services in the changes clause?
Change in description of service
Change time of performance
Change place of performance
