Unruly Behavior, means?
Prohibited behavior by CAL Article 73-3, which will jeopardize safety of the a/c, inflict damage on any person or property, disturb the good order or behave against discipline on board
Behaviors subject to prohibition order, means?
Unruly behaviors which are defined in Article 164-16 (effectively the bogan story)
The captain has the authority too issue a prohibition order to a person to cease repeating or continuing such unruly behaviors
Prohibition Order, means?
The captains order stated in Article 73-4 (5) “A bogan story”, which prohibits “Behaviors subject to prohibition order”
How is the decision made to load or off-load a suspicious passenger?
6-3-2
- If it was decided that a suspicious passenger can board the aircraft, they must notify the captain and chief purser
- The chief purser shall report to the captain and a person in charge of passenger service about the suspicious passenger, even when they’ve been previously advised; then after discussion between CAPT, CP and the person in charge of passenger service, shall decide on their boarding; finally
- the captain has every right to take every measure to deplane him/her, if they are judged to take unruly behavior from door-close to door-open
Counter action against unruly behavior in an airplane?
- Monitor the cabin intially and pay attention to suppressing the unruly behaviors
- The CA who finds unruly behaviors shall notify the CP and explain to stop the UB, and shall be done with multiple CA’s
- the CP shall notify the CAPT immediately
- the CP shall present the WARNING LETTER after the captains authorisation to stop the behaviors.
- finally if the situation requires, issue a PROHIBITION ORDER
Issue of the PROHIBITION ORDER
When it corresponds to the “Behaviors subject to the prohibition order” (a bogan story), the captain can issue the PROHIBITION ORDER
- When the passenger continues the UB after CA’s explination, the following actions shall apply
- Issue the prohibition order, which shall be handed out with multi-cabin attendants
- if this doesn’t stop the behavior after the prohibition order is issued, the CP shall advise the CAPT
After PROHIBITION ORDER given
The CAPT shall order an ANA employee (if on board) or another trustworthy passenger on board to supervise the passenger, etc and
The CAPT shall report the situation to OMC or destination ground personnel, operations
IF the passenger continues the unruly behavior?
If the passenger acts against the criminal law or the prohibition order, then the CAPT shall request police standby
The CAPT should restrain the passenger or divert to a suitable airport (if considered a threat to the safety of the flight)
The CAPT shall notify ATC at the landing airport in advance when the passenger is restrained, or in the case of diversion for the purpose of disembarking the passenger concerned.
What should be recorded in the case of unruly behavior?
The CP shall record passenger name, situation, third parties testimony, and so on..
If the UB violated criminal law or the order, the CP shall call someone to witness
CATEGORY I
Hijacking or damaging an airplane; and
Violence against crew members or passengers, damage to property
CATEGORY II
The following behaviors expressly specified as violation of the Aeronautics Law and the “Prohibition Order” will be applied. If they don’t obey the P.O. they will be punished
The Bogan Story
- Operating the handle or other mechanisms of a cabin door or an emergency exit
- Smoking in the lavatory
- Action that interferes with the duty of the crew members and that they may hinder the safety of the airplane
- Using an electronic device prohibited by the MLIT
- Not fastening the seat belt during the captain ordered to fasten the seat belt
- Not returning the back of the seat, table, footrest, to the original position during takeoff and landing
- Leaving baggage where it might obstruct an emergency evacuation
- Operating, moving or damaging emergency equipment
CATEGORY II - Takeoff and Landing definitions?
Takeoff: Commencement of boarding until the end of the critical phase regarding deparrture
Landing: beginning of the critical phase regarding arrival until the seatbelt sign has been turned off
Category III
Behaviors specified as violating the aeronautics law, but not to be punished, for eg
- Smoking in a no-smoking area (except the lavatory); or
- Shouting or making noise without reasonable reasons
What measures can you take if a CATEGORY I?
- Issue a WARNING letter
- Take action such as restraint, etc if necessary (Article 73-4-1)
- Ask ground personnel, operations to arrange police standby
What measures can you take if a CATEGORY II?
- Issue a PROHIBITION ORDER, telling not to do the same behavior continuously or repeatedly. If they do not obey, then issue a PROHIBITION LETTER
- In the case of habitual (past occurrences) or malicious (intentional), the CAPT shall order the PROHIBITION ORDER immediately after recognising the initial behavior
