“No person shall board, as pilot in command, an aircraft used for air transport services specified by MLITT unless he/she has obtained the approval of the Minister with regard to the required knowledge and skill for pilot in command as may be specified by the Ordinances.”

Article 163(1) specifies that the aircraft type must be greater than 5,700kg;

Article 163 (2) - Knowledge and Skill, shall cover the following…

(i) The operation of the aircraft
- Pre-take off checks
- Dispatchers approval of aircraft departure and changes to the flight plan
- Supervision of flight and cabin crew members
- Safety management of aircraft operations, including measures to deter safety, threatening behavior etc and crisis management

(ii) Aircraft maneuvers and measures in normal and non-normal condtions

Prohibition of safety impeding acts (Authority), and what are some examples?

Article 73-4

A

“The pilot in command may, from the moment when all external doors of the aircraft are closed for takeoff until the moment when any such door is opened for disembarkation after landing, in the case where he/she has reasonable grounds to believe that a person on board the aircraft has committed or is about to commit any safety impeding act, impose upon such person restraint or other necessary measures… to deter the act, or disembark the offending person…”

Article 164-16

(i) An act of operating the opening and closing device of an entrance or an emergency door without any proper reason
(ii) An act of smoking in a toilet
(iii) An act of impeding execution of the duty of one or more personnel on board of aircraft and consequently may affect the maintenance of safety of subject aircraft, the protection of persons other than the one who commits said act or properties within said aircraft, or the maintenance of order or discipline within said aircraft
(iv) An act of activating without any proper reason a mobile telephone or any other electronic device that may hinder safety of aircraft navigation, which is set forth in a public notice issued by the Minister of Land, Infrastructure, Transport and Tourism
(v) An act of failing to use a safety belt without any proper reason in a take-off, landing, or any other case where the pilot in chief instructs the use of it.
(vi) An act of failing in take-off or landing to return the back of a seat, table, or foot rest to its original position without any proper reason
(vii) An act of placing without any proper reason the baggage on an aisle or any other place, eventually blocking evacuation in an emergency
(viii) An act of operating or displacing an emergency device or equipment, or damaging the original functions of one of these objects.

What is the captains responsibilities?

OM 8-10

A

(HINT: Full Responsibility to Direct May Not Ensure Flight deck Will be Responsible)

  1. The captain shall have full and final authority for exercising judgement and taking actions to ensure the safety of flight.
  2. During flight, the captain shall assume the full responsibility for the safety of all persons and cargo on board his/her airplane and for the safe operation of his/her airplane.
  3. The captain shall direct and supervise all other crew members on board his/her airplane in performing their duties.
  4. The captain may delegate a part of his/her duties to another flight crew member on his/her own responsibility.
  5. The captain shall not leave the flight deck for the purpose of taking rest unless the deputy captain takes the pilot seat.
  6. Ensure A flight crew member qualified for the Area/Airport shall take the pilot seat during takeoff or landing.
  7. The captain shall be on the flight deck during takeoff or landing to the extent possible, even if he/she is not in charge of manipulating the airplane.
  8. When the captain leaves the flight deck, he/she shall be required to give instructions to his/her proxy about items anticipated, and receive reports related to the operations during his/her absence immediately upon his/her return.
  9. The captain shall assume the responsibilities for keeping the Flight Logbook(hereinafter referred to the Journey Log & Radio Log) and General Declaration.
  10. If three or more pilots are in composition, the above mentioned 2 through 4 and 8 shall apply to the deputy captain during take-over.

Prior to the flight, the captain shall?

Regarding CAPT DUTIES, OM 8-11

A

Pre-flight story before take-off…

(1) Mutually check the mental, physical and fatigue condition of all flight crew members and report the result to the ground personnel, operations. Furthermore, based on the “Alcohol Check Implementation Procedures”, check the alcohol content in breath before the series of flights.
(2) Check all NOTAMs pertaining to the airways or the airports concerned;
(3) Check the latest weather data available as to the departure airport, destination airport, alternate airports and enroute with their forecasts included;
(4) Check and ensure all up weight, center of gravity, the number of passengers, and loading distribution by means of Weight & Balance Data;
(5) Check and ensure the safety of loading;
(6) Check and ensure the amount, type, and quality of the fuel and the amount of high pressure oil, etc.;
(7) Check and ensure the condition of his/her airplane and its equipment, and sign on the required forms;
(8) Check and ensure the installation of all required documents and tools;
(9) Check that the operational flight plan is prepared in accordance with applicable rules, regulations and this Manual, and ensure the safety of the flight concerned. After confirming operational flight plan, he/she shall, with the concurrence of the flight dispatcher on duty, approve it;
(10) Check and ensure each flight crew member’s duties in accordance with the crew composition;
(11) Conduct Crew Briefing;
(12) Keep a person using the jump seat well informed of matters that demand special attention, such as action to be taken in case an emergency arises like hijacking, the use of an oxygen mask and a life vest etc.;
(13) Confirm the hand carry articles to be carried on board the airplane; and
(14) Confirm that safety instruction to passengers in accordance with 7-3 of this Manual has been conducted by cabin attendants prior to take-off.

  1. Adhere to rules and procedures
  2. Confirm that safety instructions has been completed by cabin attendants prior to takeoff based on 7-3;
  3. Normally manipulate the flight controls on the left seat except when he/she permits the co-pilot to manipulate the flight controls in accordance with provision 8-12 of this Manual;
  4. Direct and supervise all other crew members under his/her command to achieve the best flight under adequate discipline;
  5. Revise the Company Clearance in accordance with 3-3-3 of this Manual when he/she considers it appropriate in the interest of the safety of flight; and
  6. Comply with the procedures specified in 10-6 of this Manual in the event that he/she has in sight any airplane or vessels in distress

  1. Sign on Journey Log and Radio Log;
  2. Submit a report, if requested, to the pertinent authority and such other reports and forms as required in connection with the flight;
  3. Direct and supervise all persons on board when operating an international flight to assure smooth CIQ etc.
  4. Conduct De-Briefing; and
  5. Notify the maintenance personnel of any mechanical irregularities of the airplane which came to his/her attention during flight.
