Definition: “Simultaneous Photographic Lineup” is
Array of photographs (1 susp, 5 fillers) similar in appearance, presented all at the same time to vic/wits.
Definition: “Sequential Photographic Lineup” is?
Array of photographs (1 susp, 5 fillers) similar in appearance, presented one at a time to vic/wits.
Definition: “Physical Lineup” is?
Array of individuals (1 susp, 5 fillers) similar in appearance, presented one at a time to vic/wits. Also refereed as a “live lineup” or “Body Lineup”.
Definition: “Field ID/Show-up” is?
procedure in which a vic/wit is presented w/single suspect within a short period of time following the commission of a crime for the purpose of if vic/wit can ID or eliminate the suspect.
Definition: “Independent (Blind) Administrator is?
An officer who does not know the ID of the suspect in a photographic or physical lineup and does not know which persons/photographs are the fillers.
Definition: “Independent (Blinded) Administrator is?
An officer who does know the identity of the suspect in the photographic/physical lineup. But does not know the order or which picture the vic/wit is looking at (the administrator should not be able to see the pictures handing to the vic/wit. Or does not know the number position the suspect is in a simultaneous line up.
What is a “Confidence statement”?
A statement in their own words on how certain they are of an ID (this is taken immediately after an ID is made and without placing a numerical number to it).
For a photographic lineup which method shall be used first when practical?
Independent Blind Administrator.
In addition to the suspect how many fillers should be included in a lineup?
at least 5.
With policy/procedure how will juveniles be used in adult lineups and how will adults be used in juvenile lineups?
Juveniles will not be used in adult lineups. Adult may be used in Juvenile lineups as long at they meet the appearance.
If the vic/wit recognizes or ID’s someone in the lineup, the officer will ask what and how will the officer transcribe that statement. Also if a sequential lineup ID is made before the end what must be done?
ask how certain they are of the ID and a confidence statement is taken where the officer will use their exact words regarding certainty. If a sequential lineup the entire lineup must still be presented.
Does a person have a right to a lawyer present at any photographic lineup either before or after an arrest?
No. No person has a right for the lawyer.
After and If an ID is made the wit/vic does what to a confidence statement and picture that is ID’d?
The vic/wit confidence statement is written down and is signed by vic/wit. Next to the picture ID’d the vic/wit will put the date/time and their initials.
A physical lineup can be used, in a room designated for such use and if….
the suspect in not in custody and they are asked to voluntarily participate in the lineup.
In situations where pc does not exist, but sworn personnel have temp detained a subject matching general eyewitness descriptions the personnel may use;
a Field ID/Show Up Lineup.
