What are some examples of serious misconduct?
An arrest or criminal charge of an MPD member, a protection order against a member, unlawful discrimination, unlawful stop, arrest or seizure, false arrest or charges, retaliation or retribution, intentional provision of false information in any official report, log, or electronic transmittal of information. Any APO charge that is dismissed based on the member’s credibility, any constitutional violation discovered during the course of a criminal case or judicial proceeding. civil lawsuits alleging sworn member misconduct, civil lawsuits alleging acts of physical violence, racial bias or dishonesty, positive drug screenings.
What is the timeline for the investigating member to complete the investigation?
30 days from date of IS numbers
How long does the commanding official have for review of the investigation?
4 days (Day 31-35 from date of IS numbers)
How long does the Bureau have to review the investigations
4 days (Day 36-40)
How long does IAB have for final review
4 days (41-45).
When must investigations be completed and submitted through the chain of command to IAB?
Within 45 business days.
When must the investigating official contact the complainant for an external complaint?
Within 3 business days of receipt of the complaint.
If the investigating official discovered additional misconduct, who is responsible for investigating that misconduct?
The original investigating official
If an OPC complaint has no evidence of misconduct or policy violations, what should the investigating official do?
Email the OPC liaison with the investigative findings and request a rapid resolution.
In cases of serious misconduct, who shall be notified?
The Watch Commander and IAD (through CIC).
