What is the function of the Auckland Urban Design Panel (AUDP)?
The Auckland Urban Design Panel (AUDP) plays a key role in improving the quality of the built environment across the Auckland region.
The role of the panel is to:
- provide independent urban design advice to promote good design and a quality environment
- provide pre-application advice to developers and council representatives on private and public developments
- provide urban design advice to us on large or controversial council-initiated projects provide advice to us on any proposed policy and statutory tools that have an urban design impact.
The panel is an independent advisory body and does not have statutory decision-making powers.
What is the Auckland Unitary Plan?
Formed under the RMA, it provides a framework for managing Auckland’s resources and planning
The Unitary Plan guides the use of Auckland’s natural and physical resources, including land development, by determining:
- what can be built and where
- how to create a higher quality and more compact Auckland
- how to provide for rural activities
- how to maintain the marine environment.
What should you do if something is outside of your expertise?

What are sub-consultants?
- NZIA does not reccomend this!
- Consultant engaged and paid by Architect
- NZIA Proforma – Agreement for Sub Consultants Services or
- IPENZ Short form Agreement for Consultant Engagement
- Architect takes full responsibility for their performance
- Advantage is more control – can manage them more closely
- Insurance cover must be back to back. Request Insurance cover notes.
- A lot more work, invoicing, administration. Additional fees required to cover this
Whare are seperate consultants
- Client engages and pays consultant directly
- Contract between the client and the consultant
- IPENZ Short form Agreement for Consultant Engagement or
- NZIA Proforma Agreement for Separate Consultant Services
- Client must give all instructions through the architect (AAS)
- Architects responsibility is only for the co-ordination of their services
- No responsibility for their work.
- Less control in terms of timing/quality of work etc.
- Less risky & therefore preferred.
- Client still needs to ensure they have insurances in place
What are the Key clauses in NZIA sub-consultant commissioning agreement?
- The consultant must perform services with reasonable care, skill, and diligence.
- Consumer Guarantees Act applies if the client is a consumer.
- Sub-consultants must obtain approvals from the architect before proceeding to the next stage.
- If a sub-consultant breaches a duty of care, they are liable to the architect for damages, loss, or expenses.
- Sub-consultants must hold and maintain Professional Indemnity (PI) Insurance for six years post-completion.
- Compliance with instructions given by the architect is mandatory.
What are the Key clauses in NZIA separate-consultant commissioning agreement.
- Agreement between the client and a separate consultant.
- The architect is engaged separately by the client in a coordinating role.
- Sub-consultants must take instructions from the architect.
- The consultant is to perform services with reasonable care, skill, and diligence, aligning with the client’s program timeline.
- The client pays the separate sub-consultant.
- Consumer Guarantees Act applies if the client is a consumer.
- Schedule of attachments includes the scope of services, fees, and insurances.

What is Schedule 112 and 115 of the Building Act?
Section 112 sets out the requirements for altering an existing building that is not earthquake prone.

What is an outline plan of works OPW?
An outline plan of works lets us know about proposed work on a designated site.
This work should comply with use of the site specified in the designation. For example, building a classroom on a site designated for the Ministry of Education.
If the structure does not comply with the specified use, the requiring authority (for example, Spark or Watercare) will need to get a resource consent from us, rather than follow the outline plan of works process.
What is a requiring authority?
Section 166 of RMA. Increased powers under Public Works Act 1981. i.e. gain retrospective consents after emergency.
