Convention of Tokyo 1963

A

gives juridiction to aircraft state of registration in case of criminal or offense event on inflight onboard

inflight means: from doors open to doors closed

Examples:
ie - anyone that jeapordises or threatens saftey of people and aircraft such as abusive or disorderly person or anything serious

**Aircraft commander is empowered **to:
1. disembark the person
2. deliver the person to authority to competent authority upon landing

To do this, the offender must be restrained:
3. ask for crew to act/restrain the person
4. ask other passengers to assist

Convention of Montreal 1999

A

it’s an updated version of:
* Warsaw 1929 legilation

What is it?
* it’s a set of legislation related to the an airline’s liability towards a customer when things go wrong

What does it apply to:
* This applies to international flights carrying people, cargo and baggage

  • It establishes limits of an airline’s liability (when neglicent) for:
    1. death and personal injury of a passenger
    1. destruction, loss and delay of luggage and cargo
  • These liabilities apply whether ticket/receipt/waybill has been or hasn’t been issued
    mail is not included
    ** includes bags from moment of check in till offloading**
    Limits of liability under MC99
  • Compensation is calculated in Special Drawing Rights (SDR) - an international currency created by International Monetary Fund
  • airline pays a specific set compensation per passenger (not per bag) = 1131 SDR

An individual or collective carriage document must be supplied to a passenger. Even if not given, the contract between airline and passenger is binding

buggage identification tag must be provided for checked baggage

passenger should be given MC99 wirtten notice and its compensation limits

Passenger rights

A

Provides compensation to passengers if
- forced/denied boarding
- cancellations & delays

**applicabale to passengers **
- Departing from EU airports
- Flying into EU airports

Re-imbursement for flight cancelation
- compensation
- care
- return flight to departure country or re-routing

Re-imbursement for flight delays
If more than 2 hrs
- 2 free calls/emails
- free meal and refreshments
If more than 5 hrs
- ticket compensation to departure point
if overnight delay
- hotel stay & transport

for passenger to be applicable
- passenger has confirmed reservation
- passenger is present at publshed check in time
- passenger is 45 min there before departure (if checkin time not published)
