What is sponsorship?

A

1.An individual enters the US by family based or certain employment based sponsorship
2. the sponsor assigns, an affidavit of support saying that they will be legally and financially responsible for the non-citizen
3. they promised to provide enough financial support to maintain the immigrant at or above 125% of the federal federal poverty line (FPL)

Their green card or LPR card would be able to show when they became a resident, the category code and their country of origin and the US CIS or alien number

*if they are the victim of human trafficking, domestic violence, or other serious crimes (up to one year)

*is in their fourth or fifth year of the date of entry DOE

What are CFAP state deeming regulations?

A

They require from 0 to 3 years of from date of entry (DOE)-sponsorship, deeming rules, apply meaning they must provide income and unearned income and household verification of sponsor,
from 4 or 5 years from date of entry (DOE)sponsorship deeming rules do not apply. They are given a pass and then
beginning the sixth year, they are now eligible for federal benefits and provide sponsors’ info

What is the roadmap for qualified non-citizens in applying for Cal fresh?

A
  1. determine if the qualified noncitizen is sponsored and what type of funding source they will have either CFAP or SNAP
  2. if sponsored see if they made any exemptions to sponsorship regulations
  3. if an exemption is met, do not ask for sponsors information. If no exemptions exist Inform the customer of their three choices.
    their choices are either:
    evaluate for indigenous or
    provide sponsor’s information or
    opt out

 What is indigent in regards to being sponsored?

A

It is when the non-citizen’s sponsored person is unable to financially take care of them

How do you determine for indigence?

A

You look at non-citizen’s household income,
any cash contributions example sponsor, gives $200 to non-citizen each month
look at in-kind money. This is example for offering a room to live in, and the utilities are paid for him that would be in the desk aid. then
compare to the 130% FPL to see if they qualify for indigency

What form do you give if non-citizen qualifies for indigency?

A

Provide 09-99 form for non-citizen to fill out to then give to USCIS

What is the SAR 22 form?

A

It is a form that’s given out at intake recertification, and any time a sponsored person is requesting cash aid and/or Cal fresh services. This form is only given to non-citizens who are sponsored.
