When is an ADRT not valid in cases where life-sustaining treatment is required?

A
  • The ADRT must be signed and countersigned by a witness.
  • The patient must have had capacity.
  • The patient must be over 18 years old.
  • If a person is detained under the Mental Health Act 2005.
  • The ADRT must include a statement that applies even if the patient’s life were to be at risk.
  • Discuss with MDT if time allows.
  • If uncertain, give life-sustaining treatment and document everything thoroughly in the event of legal challenge.
