What enforcement actions will an umos take for an unlawful eviction violation?

A

Summons violator if:
A. In cases where violator is properly identified and occupant permitted to re-enter the dwelling.
B. Prepare a separate summons for EACH offense. (Sign comp info part if violation observed. If not, have complainant sign)
C. Return dates are at least 21 Days from date of summons.

Arrest violator if:
A. Violator cannot be properly identified.
B. Refuses to permit occupant to re-enter or who through physical obstruction prevents the occupant from re-entering.
C. Arrestee brought to criminal court No DAT issued and no Photo.

Note: Refer evicted persons who are unable to secure temporary housing to the NYC Dept of Homeless Services.

No fingerprints or DAT for this charge.

What is the procedure for Driveway Tow program?

  1. Ascertain if unoccupied vehicle is stolen
  2. Determine if registered owner is also owner of premises.
  3. Issue summons for Obstructed Driveway if vehicle not stolen and owner owner/lessee is not involved.
  4. Prepare PETS worksheet and deliver to DO.

DO

  1. Notify SPIS for each vehicle removed, whether Rotow or private tow
  2. Insert Driveway Tow in remarks of RoTow log if vehicle removed.
  3. Ensure PETS worksheet is entered.

Note:

  • If RoTow operator refuses Driveway Tow, prepare a violation notice and forward to DCA.
  • If person arrives on scene, or gets in vehicle, vehicle may be allowed to leave if person pays no more that 1/2 the tow price.
  • Licensed tow operator may not tow a vehicle without owner/lessee permission and with authorization form filled out.
  • Marked Emergency Vehicles are exempt but may tow a non-emergency governmental entity.

C. Attempt to disconnect alarm wire from battery, if owner not located.
D. Request ESU if unable to get in hood or passenger compartment
E. Activity Log entry of efforts and damage to vehicle
F. Hand written note placed in windshield of vehicle

If alarm still audible after 3 minutes:

  1. Take steps to disconnect alarm without damaging vehicle
  2. ECB summons to vehicle and place in conspicuous manner
  3. RoTow vehicle if unable to disconnect alarm
  4. Prepare PETS worksheet Note: ECB summons not mandatory in all cases (issue based on amounts of complaints from public or chronic problem)

If alarm sounds for less than than 3 minutes, resets and sounds again, it shall be deemed as one continuous action and subject to enforcement.

What are the snow emergency regulations?

A

When FINEST message is transmitted the DOT Commish has activated a Snow Emergency:
UMOS
1. Issue TR summons for vehicles abandoned or parked illegally on a snow street/route, or operating vehicle without snow tires/chains and vehicle is stuck.

Note: If vehicle is observed on a snow street without snow tires and vehicle is not immobilized, warn driver to exit street.

Snow Removal

After snow has stopped falling:
UMOS
1. Inform owner of obligation to remove snow from sidewalk and hydrants
2. Serve C-Summons if snow is not removed 4 hours after snowfall stops
