Main focus of zoning
Focused on regulating overcrowding and overdevelopment (after NYC in 1916 40-story high building cut off light from neighboring properties)
Land Zoning
The division of the land of a city, county, or other jurisdiction, into districts or zones.
Zoning Restrictions
- Regulation of the use and intensity of use of a particular parcel of land.
- Protection against discordant nuisances such as factories or commercial buildings.
- Protection against the undesirable business (bars, poolrooms, and adult bookstores.
- Protection against dangerous, hazardous industries such as toxic substances
- Protection of light, air, and open space, often regulating the size of the lot they are to occupy.
Also controls the location of the building on a site because of setbacks
Nonconforming uses
Uses that do not comply with current zoning regulations but were permitted by zoning ordinances in effect when the structure was built.
The building can be used as planned but will not allow for further expansion or alteration beyond regular repairs
Conditional Use
Use that is permitted by zoning authority with certain restrictions attached when the proposed use is not normally permitted in location. Is excepted if it’s found to be of public interest.

Variances
When particular zoning in a place unintended burdens on particular parcels of lands requests zoning variance. can only be used where exact and literal ordinance would cause undue hardship
Applications of zoning ordinances
Results in segregation of permitted uses, control of population density, provision for parking ad loading
Building forms influenced by zoning through heigh, size, and setbacks
Difference between Zoning and IBC
Zoning ordinanes deals with land use restriction of function, size, and certain exterior aspects. vs Building code manages structural and mechanical aspects of a building as they affect public health, safety, and welfare
Setbacks
Encourage more open space in a residential neighborhood, provide fire-fighting access to sides, the rear of the building,
provide off-street parking or space
front setbacks encourage openness in some zones
FAR
Floor area ratio; total allowable floor area to the area of the building site
Off-Street Parking
Number of off-street parking in commercial spaces often expressed in terms of rentable floor space.
Residential minimum of off street parking can be related to the number of rooms in a total aprtment building
Easement
Allows a property owner to use the property of another for a specific use, such as to gain access to private land for placing and maintaining utility services.
