Right to safety and good care - 5
Facility must provide services to keep your physical and mental health, sense of satisfaction at highest practical levels
Facility must be clean, stay a healthy temperature
Must not be abused by anyone - physically, verbally, mentally, sexually
Facility must not physically restrain you unless no other way to keep you safe and you agree
You may be given medicine to change mood or how you think only with your permission, only as part of plan to change or remove problems
Right to participate in own care - 13
Develop written care plan
You may go to care plan conference
May choose to have family/friends at conference
Choose your own doctor
Facility must tell you the name and specialty of each doctor, contact
You have right to be in charge of taking your own medicine
You have the right to refuse any medical treatment
You have the right to complete information on your medical condition
You have right to make Living Will or durable power of attorney for HC
You may refuse to participate in experimental treatment
Facility must allow you to see medical records within 24 hours
Facility may not require you to work
You have right to move out of facility

Facility must knock before entering
Facility may not give info about you or care to unauthorized persons

You may ask any visitor to leave

Right to manage own money
If you ask, facility must manage your money for you
Facility may spend your money only with your permission
Facility must give you itemized written statement
Facility must put your money in bank earning interest
If facility manages and you get medicaid, must give you $200 warning
If you die, Facility must give family final accounting within 30 days
You may see your financial record any time
Personal Property - 4
Right to keep and wear your own personal appropriate clothing
Right to keep and use your own property
Right to expect facility to keep small valuables in safe place
Facility must try to keep your property from being lost or stolen
Paying for your care - 5
If paying for your care, must be given contract details
Facility must not require anyone else to sign if you cannot pay
Facility must give you information how to apply for medicaid/medicare
Right to apply for medicaid/medicare
If you get medicaid, facility must not make you pay for anything medicaid pays for.
Stay in your facility - 10
Right to stay in facility unless dangerous, medical reason, cannot pay, facility closes
Must be given written notice 21 or 30 days prior
You have right to appeal
Before facility transfers/discharges, must prepare/orient to assure safe
Cannot be forced out because applying for medicaid
Right to ask for LTC Ombudsman for help in appeal
If development disability, may ask Equip for Equality for help in appeal
Must be allowed to return to facility after hospitalized
If you get medicaid and hospitalized less than 10 days, right to return even if ejected
Right to be told in advance if room or roommate changed
Rights as citizen and facility resident - 10
Facility must let you see reports of inspections
You do not lose your rights as a US citizen for bing in LTC.
If court has appointed legal guardian, they may exercise your rights
