What was the War Powers Resolution?
A resolution that gave Congress back the power to declare war. Requires president to submit report in 48 hours and will to remove troops after 60 days if Congress hasn’t declared war.
Why was the War Powers Resolution created?
Because of Vietnam war.
What were the Prize Cases?
Lincoln ordered a series of seizures before the declaration of war. The ruling was that the president was allowed to act because state of war existed.
What was the case of Youngstown Sheet and Tube Company v. Sawyer?
During Korean War, Truman issued order to seize and operate nations steel mills to avert effects of a work strike. Supreme Court ruled this unconstitutional because they could not take possession of private property.
What was the case of Korematsu vs. U.S.?
Order 9066 put Japanese in internment camps and Fred Korematsu sued. Court ruled act was constitutional because it was war like situation and the president does have this power.
What was the court case of Hamdi v. Rumsfeld?
An American citizen was accused of fighting for the Taliban and the government held him without access to an attorney. They ruled that Hamdi was entitled to a lawyer and released him without charge, but he was deported.
