What did you advise could be the issues with accepting Option 2 in your case Study?

Answer 1

• Client is seriously programme driven.
• Client issues lots of changes. EOTs would be plentiful.
• Adversarial relationship
• Client forced to take partial possession and have difficult mobilisation period
• PP would be an EOT and RM to Contractor
• Overlapping work areas
• Fundamentally, it would be the Client’s problem…

Question 2

Can you give an example of when you have advised your client about Sectional Completion or Partial Possession?

Answer 2

• Yes on the Hinckley project, Client wanted to award Practical Completion for political reasons with a list of snags that were not in any way de-minimis.
• Works not complete, and certainly not a snag.
• Partial possession should be taken to retain LDs and retention on uncompleted works.
• Insurance of the area would get extremely complicated.
