What is capacity?
Being able to make own decision
What does MCA 2005 state?
Everyone should be presumed to have capacity to determine their need for medical treatment
Should be assessed every time as capacity can fluctuate
How to assess capacity?
Pt must be able to:
1. Understand information about decisions - risks/ benefits/ alternative
2. Retain information
3. Use information to make dcsion
4. Communication of decision
What must be satisfied for consent to be valid?
Pt must have capacity, consent must be voluntary and informed
Can consent be implied?
Yes - for examination for example - pt sitting down and opening mouth is implied consent
What is lasting power of attorney?
LPA is legal document that enable to appoint 1+ people to help make decision if in future you lacked capacity
What are two types of LPA?
- Health and welfare
- Property and financial affairs
What is IMCA?
Independent mental capacity advocate
Independent person who supports and presents person lacking capacity - ensure MCA 2005 followed
What to do if pt can’t provide consent and has no advocate?
Hold best interest decision meeting - involve HPC and IMCA
