What if we have legal drugs that may impair our job?
Try to report to duty without being impaired but should tell immediate supervisor about them and have a physicians note authorizing.
Should we report illegal substance use by another member?
Sure should. Even possession.
Are authorized special functions at the Training Center allowed to serve alcohol to members?
Must be approved by fire chief, held after hours and no district uniforms or vehicles. Also only beer and wine not purchased with District funds.
Will a member be disciplined for seeking assistance in help for alcohol or substance abuse?
Not if the member comes forward voluntarily. Also will be given one opportunity to participate in a program. Will be confidential and progress monitored by fire chief. District has a list of programs, other programs will be considered.
Can a member use an approved out patient program?
Need to complete all necessary probation and voluntarily enroll in rehab. Can use accrued leave. Sign Acknowledgment form. Not previously enrolled in a treatment/rehab while a member of the District.
How long will a member be subject to random drug testing?
Up to 2 years, if any point it is positive then member will be terminated.
What happens if a member fails a rehab/treatment program?
If there is “good cause” for fail, then determination is made by fire chief, if fail is without “good cause” then member is terminated.
When is a member drug tested?
Upon completion of rehab/treatment program, if there is probable cause, involvement in a vehicle accident while the vehicle is in motion
Means for probable cause include?
Suspicion or reported use, sale, possession, Under the influence on duty, accident or injury on duty, demonstration of physical or behavioral symptoms, Excessive absenteeism or tardiness (use of leaves), reliable information
Steps taken after probable cause is determined
Superivisor will relieve member from duties, order them to remain in quarters and contact DC. DC will come and obtain info and take pt to approved Medical facility for testing. If consent form is not signed by member, can be terminated. Member is then escorted to place of residence.
Testing Lab steps
Maintain confidentiality, all positive results must be confirmed twice with a different method, and kept for 6 months.
What happens for a positive test result?
Member is placed on suspension and subject to disciplinary action, can include termination.
When can the fire chief suspend disciplinary action after a positive test result?
No previous incidents while employed by District. No evidence exists that the circumstances were accompanied by the sale, use or possession while on duty on on District property. No other serious violations. Not on probation still. No disciplinary action for the previous 12 months prior.
How does a member whose disciplinary action has been suspended by the chief, keep it suspended?
Cooperate fully with substance abuse evaluation and consents to and enrolls in rehab/treatment program.
Are your confidentiality rights waved if you file a grievance?
Yes.
