HPM 50.5, Chapter 2, defines three different types of Protesters. They are:
Passive Resistance Protesters
Active Resistance Protesters
Assaultive Resistance Protesters
Many passive protesters have taken a seat in a circle chanting “Save the whales! Save the whales!” but are not combative whatsoever. A few officers take their batons and begin to strike the protesters who are seated and are not assaultive in any manner. Would the use of a baton be justified?
No, control holds would be the correct level of force, your baton would be secured in the ring, or in the basic tuck position.
With the above scenario (Active Resistance Protesters), a protester punches an officer, and another protester throws a bottle at an officer. Those involved officers decide to use baton strikes to defend themselves. Would this use of force be justified against assaultive protesters?
Yes
Many active protesters have locked arms in a line and are confronting a line of your finest officers. The protesters are tense, not willing to move, some flee, and others join the line as the crowd is becoming increasingly agitated. There are reports of bottle having been thrown but none have been seen in your area. The officers have their batons in the long- extended position. Should your officers begin to strike the active protesters with their batons?
No
Officers ___ attempt to take an assaultive, resistant protester(s) into custody if the situation permits.
