5 207-01 Complaint reports (2/7/22)

  • (When GL is coupled with GLA, The complaint will be classified as GLA)*

(The attempt to commit any of the seven majors will be counted as the completed offense EXCEPT for _________ which will be classified as ________)

Crime classifications go from lowest degree to highest degree:
Ex:A felony is higher that B felony, 1st degree is higher than 2nd degree, article 140 before 150 EXCEPT petit larceny from auto (155) when coupled with crim mis 4th (145) petit larceny will come first!!!!

If any of the reported offenses is NOT one of the 7 majors, the crime classification will be determined in this order:
Category, Classification, Degree, PL article and section (CCD, PLA, PLS)

COMPLAINTS RECORDED (IN PCT OF OCC) ON A 61:

  • Pistols, revolvers, dangerous weapons possessed by a person found under circumstances requiring investigation go on a 61
  • MV/Bike collisions to which highway unit responds and conducts an investigation gets recorded on a 61
  • A deceased person for which this dept MUST notify the ME goes on a 61
  • ALL VERIFIED incidents of work disruptions at CITY constructions sites goes on a 61
  • Violations of OOP/Suspected child abuse goes on a 61

Above COMPLAINTS gets recorded in pct of occ. These complaints however are the exception to that rule: _________ (4 exceptions/Where do they get recorded?)

MOS should know there is no 61 for found property except for found guns and found drugs.

Found GUNS/dangerous weapons (requiring investigation!) get recorded on a pct complaint report.

Small amounts of drugs get recorded on a PRECINCT complaint report. Small amount of drugs are considered to be _____________ of CPCS REQUIRING INVESTIGATION will be recorded in the Pct of occurrence when you found on the STREET AND BUILDING.

Continuous events get recorded in pct in which the initial offense was committed unless (3 exceptions) the crime committed is a ____________ or ___________ or ____________.

In regards to homicide record where it occurred if unk, then record where body found!
(Remember vehicular manslaughter 1 and 2 is not considered a homicide!)

In regards to Rape/CSA we record where occurred, if unk then record where initial offense occurred. If neither is known record where C/V reports incident. (If more than 1 Rape/CSA occurred, record where initial Rape/CSA occurred)

Transit Bureau incidents that occur on a MOVING train will be recorded as occurring on the ___________ where train stops, regardless of pct or Boro boundaries.

In regards to complaint reporting, ALL pick up ARRESTS of Juvenile offenders get a recorded on a 61!
Pick up arrests of juveniles taken in to custody and charged with juvenile delinquency also get recorded on a 61!
However only these COMPLAINTS of juvenile delinquents gets recorded on 61: FEW SPIES FUN JOB

  • (Prostitution, although a photographable misd. Is not part of this acronym, only Permitting/Promoting prostitution requires a juvenile to be charged with JD)*
  • (Fraudulent accosting except 3 card monte shows up in photographable misdemeanors acronym only!)*

(Weapons offenses includes “unlawful possession” so having a switchblade or gravity knife is one of the times we prepare a 61 for juveniles)

5 207-01 Complaint reporting (4/2/22)

No information other than the narrative can go in details of 61.
If perps/victims/witnesses/vehicles don’t fit in to captions of 61, use another worksheet! (For example-10perp then use 5 forms and 10 victims then use 10 forms utilizing appropriate captions on forms-DONT just put the information of additional victims/perps/etc. in details of 61! Only narrative can go in details of 61)

Complaints reports should be transmitted by EOT by desk officer. Should be finalized within __________ of taking report.

A new 61 will be prepared and a separate serial number assigned to record Criminal Poss of Stolen Property when the person arrested is NOT charged with the original crime. (Burg,larceny, GLA, etc.)

Complaint report follow up informational (pink) must be forwarded to ______ and prepared for manual electronic storage. Staples should not be used. These reports must be forwarded within 24 hours to the appropriate units.

** All instances where an individual is suffering from, or has died from, a suspected drug overdose. Classify COMPLAINT REPORT as “ INVESTIGATE AIDED-Drug Overdose” or “Investigate DOA-Possible Drug Overdose “, as appropriate.

3 207-03 Voiding 61(4/2/22)

Desk officer determines if complaints should be voided. D.O voids 61 if__________ (4 reasons)
-An example of a 61 prepared in error (in which case we VOID it) is when we prepared a 61 for a juvenile when we should have prepared a JRSW
(Another complaint prepared in error would be a complaint of suspected terrorist activity, this would be reported to intel as per 212-12)

DO NOT void a 61 for unfounded complaints. Examples of unfounded complaints is a complaint of GLA where car was legally towed OR for a report of lost property by a complainant who later reports finding it

If 61 has NOT been finalized (and you need to void it) then the ______(new)enters reasons for voiding 61 under “details” on 61, and has worksheet filed chronologically in _________ of pct complaint file. DESK OFFICER (NEW) then utilizes VOID function on the OMNIFORM System to properly document the VOIDED complaint.
(IF NOT FINALIZED REUSE THE NUMBER!!)

If 61 has been finalized (and you need to void it) then the D.O has the command clerk prepare a ________. The command clerk attaches pct record copy of complaint follow up to pct file copy of voided Complaint Report(61).

The DESK OFFICER then amends any notifications made AFTER 61 is voided. And ensures it is distributed in same manner as voided 61.
(IF 61 FINALIZED, “MOS” (New NO more command clerk) RECLASSIFIES AS “VOID” using Omniform complaint revision!)
(After Complaint Report has been finalized, a Complaint Serial Number (Voided or Not) cannot be Changed in the OMNIFORM system).

2 207-04 Complaints occurring in another command (4/2/22)

Pcts and TD’s who cover same area have access to each other’s OMNIFORM system.
UMOS when receiving complaint from another bureau should interview complainant, make a scratch 61 and give it to the D.O.
The D.O reviews and signs the worksheet and gives it to command clerk.
The command clerk(PCT taking report)(new) sends a complaint (from a complainant) to the transit district/pct of record via ________

The command clerk should put pct/TD name in “details” of 61.

However if a compliant received in mail then the command clerk should _________________

^^(But remember IN regards to narco/vice or complaints received in writing then forward ORIGINAL written communication to ISD Detective Bureau, and file a photocopy of letter to file copy of 61 kept at command)^^
EXample: Victim got robbed yesterday in transit confine of 79pct and walk in to pct for report. Now po kim make report and give to DO 79pct , he signed it and give to PAA for input. Now DO, TD of OCC SIGNED OFF THE 61

REMEMBER DO NOT input data into the precinct/transit district OMNIFORM system UNLESS the incident which required the preparation of the COMPLAINT REPORT WORKSHEET occurred within the boundaries of the precinct/transit district of record
^^^(So basically if a complaint is made at pct for an incident that occurred in TD (same boundary as pct) then the command clerk will enter the complaint in the OMNIFORM system because they share OMNIFORM system.
HOWEVER IF complaint is made at a pct for an incident that occurred in another pct/housing OR transit TD not under same jurisdiction of pct then the command clerk WILL NOT enter it in the OMNIFORM system, but will still email
the complaint to pct/housing of occ!)

UMOS interview complainant and any witness, obtain facts and safeguard evidence. DO NOT DISTURB POSSIBLE EVIDENCE AT A CRIME SCENE.
UMOS conduct through Field Investigation. Transmit alarm, if necessary. Umos where necessary, attempt to have witness remain and immediately record their names, address, telephone numbers, dates of birth, any relevant statements whether casually or formally made , and any other pertinent information. Make preliminary classification of “COMPLAINT TYPE”. UMOS notify P/S of any Serious or Unusual Complaints.

UMOS should also make 61 and determine if complaint is closed or referred for further investigation. (Next notecard)

UMOS notify Complainant that they receive a text message from the Dept asking them to prticipate in a customer service survey; 1- Do not notify members of the public who record a complaint for matters involving Sex Crimes, domestic Violence/Family Offenses, Juvenile(defined as being 17yrs old or Younger), Homicides, or any other incident deemed inappropriate, about being contacted VIA text messgae. Make note in “DETAILS” section of Complaint Report Worksheet, if notification was made.

If victim was 65 or older and was victim of crime while still 65 and older then enter statement “VICTIM OF A SIMILAR CRIME” including time between crimes, in ___________.
Then UMOS notify D.O upon completion and hand 61 in ASAP

UMOS should notify the __________ for any info received regarding public welfare and public assistance frauds.
Ordinarily a summary arrest will NOT be made on complaints of public welfare and public assistance frauds unless other elements are present (safety of officer or other person)

Crime victim notification is done for INJURY/DEATH or loss of “essential personal property”.
UMOS should notify INNOCENT, injured victim (or surviving relative of DOA) or someone who has lost essential personal property that compensation may be available as per the Crime Victims Compensation Law. Provide victim/relative with “crime victims board information card”, and check box on 61 WORKSHEET that victim or relative was notified.
