Explain the problem?
There are privately owner residential properties on the East Coast which are imminent risk of falling on to the beach due to coastal erosion.

What constitutes imminent risk; what is the risk; who is at risk?
Anything which could cause death, injury or ill health due. The risk is the properties falling on to the beach which is public owned and used by members of the public.

What happens when at imminent risk?
Building Control can issue a section 78 notice on the property owner.

How did you proceed with this project once you were commissioned to undertake the works?
- I established a design team for the electrical and mechanical aspects
- I organised for surveys to be undertaken (Asbestos, bat scope)
- Prepared tender documentation
- Evaluated tenders and awarded the contractor
- Project Managed the scheme

Was it just one privately owned property?
All of the property were privately owned.
- The council became involved because we have a duty of care to the general public.

Did the properties all need to be demolished at the same time?
No. Properties were only demolished when they became at imminent risk.
Monthly surveys were undertaken by out coastal team via helicopter to monitor the coastal erosion. The imminent risk line was when the coast was within 10 meters of the nearest part of the property.

What legal notices were required?
Section 78. Under normal circumstances you would issue a section 80.

What is a section 78 notice; did you require any other notices?
A section 78 notice is issued by the local authority on the owner of the property should a building or structure, or part of a building or structure be dangerous, requires immediate action to remove the danger.

Why did a section 78 supersede a section 80 notice?
Section 80 is not required if the demolition is the result of a demolition order, as in this case.

What is a building regulations enforcement notice?
You may receive an enforcement notice from your local authority if they believe that building work in or around your home doesn’t comply with building regulations. What this means is that you’ll have to rectify or even remove the work which is in breach of building regulations.

Why do building control have these powers?
To ensure building work is carried out safely to prevent death, injury or ill health to the occupants and general members of the public.
