Why did you use 100% price?
Low value and low risk, as it didn’t involve specialist works
How did you deal with the reduction of the contractors valuation?
I issued a pay less notice to the contractor informing them I would be paying less than they have applied for, as per the provisions set out in ‘The Housing Grants and Regeneration Act 1996’
- I referred to the price activity sheet which itemised all the key elements of the works
- The itemised elements were carefully thought out
What advice did you give to the client regarding the contract choice?
I advised the client to use NEC3 Short Contract on 100% price.
Why was using the NEC3 ECSC appropriate?
The NEC3 Short Contract is our default contract. It is standardised across our department for ease and it ensures we all use the same terminology.

The NEC3 also aims to prevent disputes due to the collaborative approach and they have a proven track record for successful project delivery.

NEC3 Short Contract
What is the process you would take when you receive an application for payment?
I would check to see what the contractor was claiming for and check there claim against the items within Priced Activity Sheet.
I would undertake an inspection to ensure the items the contractor was claiming ‘Price for Work Done to Date’ and the materials used were as specified. Once satisfied I would make payment.
When you found the incomplete works, what did you advise the client; how did you approach the contractor?
I took photographs of the incomplete works to which I emailed the contractor reminding him that payment can only be made for completed items.
I issued a pay less notice to the contractor in which they revised their valuation.
In this instance, what was the benefits of using the NEC3 Contract?
The scheme was straight forward with minimal risk.
Did you consider any other form of contract?
I didn’t consider any other form of contract, NEC3 Short Contract is our default contract due to remaining consistent across our department. However, I do have an awareness of the JCT Minor Works contract which would have been suitable given the size and nature of this scheme.
