Legal and Ethical Considerations Flashcards
What are the 4 bioethics principles
Respect for autonomy : pt can act without influence that prevent a decision being voluntary; forms the basis of informed consent + refusal
Non-maleficence : obligation to minimize harm
Beneficence: obligation to care for pt + society
Justice: fair HC resource distribution
What 3 things do you need to ensure a patient knows in order for their consent to be deemed informed consent
- the nature of decision/procedure
-alternatives to this intervention - R + B and uncertainties related to each option
T or F: if a patient accepts + gives consent, this needs to be recorded but if they refuse, we don’t need to document this
F- document both
What doe the ON HC Consent Act Mandate
mandates that consent must be obtained for treatment, tells us who can give consent + how consent is obtained
Who can we get consent directly from
Pt or their legally authorized sub decision maker
Do we need to give time for the pt to ask questions + for us to confirm their understanding in order to get consent
Yes: must have time to ask questions + get answers
- we need to ensure they understand the procedure, its B and R, common Aes, rationale for post admin monitoring + contact info for FU
What is the definition of treatment based on the ON HC Consent Act
anything that is done for a therapeutic, preventative, palliative, diagnostic, cosmetic or HC related purpose
T or F: in ON kids are not able to give consent until they are over 10; Until then, the parent gives consent
F- in ON, a child of any age is capable of providing consent if they have the maturity, intelligence, + capacity to understand the nature + purpose of the proposed HC service
- they must also have the ability to appreciate the reasonable foreseeable consequences of their decision
** if kid meets requirements: don’t need parental consent + P consent doesn’t override kids
