miranda v. arizona
summary: Miranda had been convicted on kidnapping and rape charges. He was questioned and had confessed. He had signed a written statement w/o being told that he had a right to a lawyer, his confession was used in trial.
constitution: 5th and 6th ammendmnet
resolution: the court outlined the necessary aspects of police warnings to suspects, including the right to remain silent and to have counsel present during interrogations.
palko v. connecticut
summary: palko stole a radio and tried to get away but ended up shooting and killing 2 officers. he was convicted to second-degree murder and life-imprisonment but was changed into first-degree murder and the death sentence.
constitution: 5th and 14th ammendment
resolution: the protection against double jeopardy was not fundamental right.
planned parenthood v. casey
summary: the law required informed consent and 24 hour waiting period prior to the procedure. a minor must seek consent of one of their parents. a woman must indicate she notified her husband of her intention to abort.
constitution: 9th ammendment
resolution: undue burden: obstacle for a woman who wants an abortion before the fetus attains viability. the only provision to fail the test was the husband-notification requirement.
roe v wade
summary: roe wanted an abortion but texas prohibited abortions except to save the pregnant woman’s life.
constitution: 9th amendment
resolution: woman’s right to an abortion fell within the right to privacy. 46 states were affected by the ruling.
romer v evans
summary: colorado voters adopted amendment 2. precluding any judicial, legislative or executive action designed to protect persons from discrimination based on their homosexual, lesbian or bisexual orientation practices and relationships.
constitution: 14 ammendment
resolution: violated the equal protection clause because it singled out homosexual and bisexual persons.
