10 CFR 50.5 (deliberate misconduct)
Who does this regulation apply to?

What can happen if an individual violates this regulation?

Not only will the license be subject to fines and penalities but the individual who commits the violation may be subject to enforcement action

If an individual does not ….
“cause or would have caused, if not detected a licensee, contractor or subcontractor to be in vioation of any rule, regualtion, or order; or any term, condition, or limitation of any license issued by the Commision.”
but they do intentionally omit a piece of information that the NRC requested, are they in violation of the this regulation?
Yes, deliberately ommiting infomation that the NRC requested, or deliberately providing incomplete/ inaccurate information is also in violation of 10 CFR 50.5

What is the definition of “controls”?
i.e. 10 CFR 50.54k states that a licensed or SRO shall be present at the controls at all times during the opetation of the facility.
- Control Rods
- Make up controls
- Stm dumps
- Turbine control

What conditions must be met for a licensee to take action that departs from their license?
- emergency exists
- immediate action is needed to protect the health and safety of the public
- no procedure guidence that can provide protection is immediately apparrent
An SRO at a minimum must approve but it is preffered to get a second brain with SM (preferred) or another “Senior licensee”
10 CFR 50.46 (ECCS design Criteria)
What are the design criteria of ECCS per 10 CFR 50.46?
- 2200 deg F - prevent peak cladding temp exceed
- 17% - total oxidation of cladding < of total clad thickness
- 1% - prevent total H2 gas generated < (zirc water rxn)
- coolable geometry maintained
- long term cooling retained
10 CFR 55 (Medical certification and monitoring)
How is an operator’s health and medical condition monitored to satisfy this regulation?
- bi-annual physicals (every 24 months)
- any changes to physical condition must be reported to the NRC w/in 30 days (“incapacitation due to disability or illness during the term of an operators license. Physical or mental”)

The NRC requires a that only a person that falls under what specific catagories is allowed to control reactivity, operate the Rx?
Is Diablo Canyon a “production” or “utilization” facility?
- Licensed opertator
- in training program to obtain license (UI)
- re-activating license (UI)
Utilization, its primary purpose is not to produce Pu (plutonium)
