What is an arrest warrant?
A written order signed by a judge, Justice of the Peace, or coroner directing peace officers to apprehend a person.
Who can issue an arrest warrant?
A judge, Justice of the Peace, or coroner.
What is required for a peace officer to seek a warrant in the first instance?
Presentation of an Information to a Justice with reasonable grounds to believe it is in the public interest.
List some factors that may justify the issuance of a warrant in the first instance.
- The accused has fled
- The accused is evading capture
- Danger to the public
- Danger to the victim and/or witnesses
- Nature and/or seriousness of the offence
- All attempts to locate the suspect have been exhausted
What happens to persons arrested on a warrant in the first instance?
They must be presented to the court for a bail hearing unless the warrant is endorsed for release.
What is a warrant of committal?
A warrant issued by the court upon conviction, directing officers to arrest an individual for non-payment of a monetary penalty or other offenses.

An arrest warrant issued by a Justice when an accused fails to attend court as directed.

A warrant for the apprehension of a witness who is evading service of a subpoena or has not appeared in court.
What should happen after a material witness is arrested?
A bail hearing must be held to determine if the witness should be released until required to appear.

Enforces child and spousal court orders in Ontario.
