- conflict is between inequality between social classes
bourgeoise :
- those who owns the rules and means of production - ownership of things such as land
lower class :
- own nothing but have ability to sell their labour
- false class consciousness - inability to recognise and inequality and oppression in capitalist society

- criminogenic capitalism where crime is inevitable in a capitalist society as it is based on the exploitation of the working class and poverty may mean crime is the only way the working class can survive
- utilitarian crime such as theft
- alienation is a lack of control over ones life and then they may feel frustration and aggression leading to non utilitarian crime

- argues that crime is a rational response in a capitalist society so crime is found in all classes
- argues that laws which protects private property are the basis of capitalist economy and the ruling class have the power to make prevent laws harmful to their interests.

How does marxism and functionalism differ
A
- functionalists view laws as reflecting the value consensus and interests of society and so crime is a negative threat to social order

- that some laws benefit the working class and the ruling class and so its a “ caring face “
