General Roadway Related Powers

Section 114
Stopping Vehicles and Demanding Details. Remain stopped for as long as reasonably necessary
- Only from driver
Officer must be in uniform or if in plain clothes driving a vehicle with lights and sirens
And demand that driver states
- full name, address, DOB
- owner of car or not
- name and address of owner of the vehicle or other particulars within the driver’s knowledge to lead to identification of the owner
Powers of Arrest Section 114 (3)
Vehicle and licence checks
- Fails to stop
- Refuse to supply details
- False or misleading details
Section 115
Banning Vehicles from the Road
- Fails to comply with regulations or rules (GREEN STICKER) UNSAFE
e. g. WOF failures, exhaust, windows, cracked windscreen - Not in a safe condition to be driven on a road (PINK STICKER) DEFECTIVE
e. g. illegal modifications or structural rust
Can have conditions about driving vehicle to a specified place for repair
Always sticker passenger vehicles bus, taxis etc when in vehicle crash (green)
Section 118
Obtaining information
Give all information within 14 days for identification and apprehension of
- driver alleged to have committed any offence against any act
or - passenger has committed, aided or avoided arrest through use of a vehicle
If a fleeing vehicle, information must be given immediately
Must be owner/hirer at time of offence
Section 119
Entering Premises and Stealing Vehicles
- powers of entry to carry out breath alcohol testing (failure to stop)
- powers to seize a vehicle without a warrant in pursuit, or about to be removed/destroyed etc, or used in commission of a crime, or impractical to get a warrant
Arrests can only be made under 119
- failure to remain for EBT result
- failure to accompany
- driving under influence
- refusing to remain for blood test
- refusing to give blood
- assaulting enforcement officer

Taking keys and forbidding to drive

Seizing vehicles up to 12 hours

Suspending licences
Must suspend for 28 days
- breath alcohol over 650mcg/L
- blood alcohol over 130mcg/100mL
- breath alcohol over 400 but previous offence within 4 years
- blood alcohol over 80 and previous offence with 4 years
- failed or refused blood test at hospital or at request of enforcement officer
- 40km/h over speed limit (permanent)
- 50km/h over speed limit (temporary or towing)
Impounding boy racers (Section 96)
Must IF PRACTICAL seize and impound
- operated in a race, exhibition of speed or acceleration or
- sustained loss of traction without reasonable excuse
How many demerit points in a period before suspension?
100 in two years
3 month suspension
Authority to carry out roadside suspensions
Section 90
- When driver actively avoids being served notice of suspension

When serving
- ask for licence to confirm details
- dispatcher to Query Drivers Licence (total demerits must exceed 100)
- Complete notice and serve
