Purpose of a PSO
Family harm jobs where you know there has been an offence but there is insufficient evidence to arrest
Conditions of a PSO
- Not to physically/sexually abuse PAR or threaten to
- damage or threaten to damage property
- intimidate
- encourage another person to make contact
- watch, loiter
- follow or stop in street
Duration of time of PSO
Up to 10 days
Who is a qualified constable?
Sergeant rank or higher
Power to detain someone in relation to PSO’s
Section 32
- detain up to 2 hours to authorise and serve
- if they try to leave
ARREST
Duration of time to serve a PSO before it lapses
48 hours
What to explain to PAR and bound person
- purpose of order
- effect of order
- duration of order
- consequences of contravening the order
What to do when order is breached?
Arrest Send to Court Court will either - Order PO - Extend PSO - Do nothing
What to do when someone is summons for breaching and court is not able to see them
Release on bail
If they fail to appear then Court can issues warrant and will be arrested
When can you arrest for dealing with PSO
- refuses are fails to remain at a place where they are detained
- breaches PSO
- DETAIN when fails to comply with orders
What happens to parenting orders when a PSO is issued?
They are suspended
