Reviewing a S106 agreement to ensure the client understood the legal obligations regarding affordable housing and contributions.
Tell me about a current planning policy issue you are aware of.
Tower Hamlets - As part of their new local plan, they have proposed 80% of their affordable housing requirement to be social rent.
Although this is good to deliver the large need of social rented homes, this does restrict the number of intermediate homes that could be brought forward. Meaning that key workers who are unable to afford to live within the borough they work in and homes for them don’t come available often.
Tell me about your understanding of the law relating to conservation areas/listed buildings/planning policy/S106 agreements/CIL?
Conservation Areas: Designated by local authorities to preserve architectural and historic significance, subject to strict development regulations.
Listed Buildings: Structures of special interest protected by law, requiring specific consent for alterations or demolition.
Planning Policy: Governs development at national, regional, and local levels, ensuring compliance is crucial for obtaining planning permission.
Section 106 Agreements: Legal contracts between developers and local authorities, outlining obligations to mitigate development impacts.
Community Infrastructure Levy (CIL): Planning charge on new developments to fund local infrastructure projects.
What is a listed building?
They are legally protected buildings from alterations or demolition without specific consent.
What is a conservation area?
Its a designated area which is considered to have special architectural or historic consent. Protected by Law to preserve or enhance their character and appearance.
