Who is responsible for H&S within your firm?
Everyone. The Health and Safety at Work Act says that employees have a duty to themselves and to each other.
We have a in-house ‘competent person’ as required by the Act.

The HSE provides the following guidance:
- Appointing a competent person to manage your Health & Safety.

- Prepare a Health & Safety policy.
- Consulting employees when necessary.
- Providing the right facilities.
- Maintaining first aid standards.
- Insuring your business.
- Reporting on accidents and any illness.
- Display the Health & Safety Law poster.
- Understand the Health & Safety at Work Act 1974.
What are the penalties under current health & safety legislation?
Failure to comply with these requirements can have serious consequences – for both organisations and individuals. Sanctions include fines, imprisonment and disqualification.
Is it a criminal offence to breach the H&S at Work Act 1974?

What is a risk assessment?
A risk assessment will protect your workers and your business, as well as help you to comply with law. The Health and Safety Executive (HSE) defines a risk assessment as:
“a careful examination of what, in your work, could cause harm to people, so that you can weigh up whether you have taken enough precautions or should do more to prevent harm”

What is the general duty on employers under the H&S at work act 1974
To ensure health, safety and wellbeing of employees and other affected persons is not at risk, so far as is reasonably practicable

What should an employer’s H&S policy include to comply with their duties under the H&S at Work Act 1974?
- Line management structure (leading from the top)
- Clear accountability, policies and procedures
- Staff training
- Adequate resources
- Appropriate insurance
