Who can be evicted from property?
Anyone unless:
○ Lodgers
○ People in holiday lets
○ Lettings for no monies worth
○ People under asylum seeker regulations
○ Lettings to a former trespasser
- Occupants in a public sector hotel
What is a tenancy?
Form of ownership of landlord
If a landlord wants to evict someone they must:
Need possession order otherwise it’s a criminal offence (local authority deal with).
Must serve valid notice first, then possession granted in local authority court.
If occupier doesn’t leave, apply for warrant of eviction/bailiff’s warrant - attempting to remove without this is criminal offence.
What is harassment in relation to tenants?
Acts likely to cause the occupier to give up their accommodation
If tenant is harassed
They can sue landlord in civil court as well as for criminal offences of harassment
