Expert witnesses
They are people with a particular area of special knowledge.
Lay witnesses
Other witnesses, such as eyewitnesses, character witnesses, and alibi witnesses with personal knowledge.
Lay witnesses must complete 4 qualifications in order to be qualified to testify…
1) Personal knowledge
2) Memory
3) Communicate
4) Appreciation to tell the truth
Personal knowledge
Meaning lay witness testifies to things they personally saw, heard, or otherwise experienced with their own senses.
Memory
The witness must have some memory of what she saw. Even if she forgot what she saw at the event, if their memory was restored before the trial they can testify.
Communicate
The witness must be able to communicate what they saw. If the person is so disabled to not be able to speak they cannot testify.
Signed Affidavit
Piece of paper for evidence.
