[CT] Chapter 2: The Purpose of the Criminal Trail Flashcards
What is the purpose of the criminal trail?
The purpose of the criminal trial to determine whether the defendant is guilty or not guilty.
Beyond a reasonable doubt
This means that a judge or jury can conclude that someone is guilty and have a lingering doubt as long as the doubt is not logical or reasonable.
Acquit the suspect/defendant
The jury or judge find the suspect, not guilty and the individual is free to go.
Reasonable uncertainty
At determination of not guilty, can simply mean that the judge or Jury has a reasonable doubt as to whether the defendant actually committed the crime, even though the other factors seemed to indicate that there is a possibility that he may have.
True or false?
Not guilty=innocent
False
(our system of justice says a person should not be deprived of his life or liberty when a reasonable uncertainty exists at his guilt. But this does not mean the person is fully innocent)
