Inadmissible evidence
Based upon the evidentiary law, the judge determines cannot be heard by the jury.
Admissible evidence
Is evidence that the judge rules may be presented to the jury for consideration.
Objection
When an attorney poses a question to a witness that would violate the evidentiary law, the opposing attorney should make an objection.
Waiver
It’s a failure to make an objection between the time the question is asked and the witness answer, the objection is lost and the jury hears the otherwise
inadmissible evidence.
Overruled
An objection that is overruled means the judge disagrees with the objection, and the witness may respond to the attorney’s question.
Sustained
An objection that is sustained means the judge agrees with the objecting attorney and the question and/or answer must be disregarded.
