What must acceptance be? (4)
In response to the offer, unqualified, communicated, may be necessary to follow a prescribed mode of acceptance.
Who can accept an offer? (2)
Only to the person who the offer is made to and if the offer is made generally to the world then everyone with the notice is a valid offeree.
What is sometimes called the ‘mirror image rule’? (1)
Acceptance must be unqualified and must correspond exactly with the terms of the offer.
What question may arise when the offeror prescribed a mode of acceptance? (1)
Whether communication of acceptance in any other manner will suffice.
What does the case of TINN V HOFFMAN 1873 demonstrate? (2)
If the offeror makes it clear that they will not be bound unless acceptance is communicated in that precise way then only that mode will suffice. If it is not mandatory another mode of acceptance which is no less advantageous to the offeror will bind them.
