Bill of Rights
-the first 10 amendments to the Constitution
It spells out Americans’ rights in relation to their government. It guarantees civil rights and liberties to the individual.
1st Amendment
*FREEDOM OF RELIGION/Gov’t cannot set a specific religion
*FREEDOM OF SPEECH
*FREEDOM OF PRESS
*FREEDOM OF ASSEMBLY
*RIGHT TO PETITION
2nd Amendment
The Right to own a weapon for a Well Regulated Militia
3rd Amendment
THE RIGHT FOR CITIZENS NOT TO QUARTER (HOUSE) SOLDIERS
4th Amendment
*NO UNREASONABLE SEARCHES AND SEIZURES (CAPTURE OF ITEMS)
*A POLICE OFFICER MUST HAVE A WARRANT GIVEN TO HIM BY A JUDGE AND PROBABLE CAUSE
5th Amendment
*YOU DO NOT HAVE TO TESTIFY AGAINST YOURSELF –”I PLEAD
THE FIFTH”
*DUE PROCESS THROUGH THE JUSTICE SYSTEM (COURTS)
BEFORE YOU ARE CONVICTED
*THE GOVERNMENT CANNOT TAKE YOUR LAND UNLESS IT
PROVIDES COMPENSATION (FAIR PAYMENT), THIS IS KNOWN
AS EMINENT DOMAIN
*YOU CANNOT BE TRIED FOR THE SAME CRIME TWICE- THAT
WOULD BE “DOUBLE JEOPARDY”
6th Amendment
*RIGHT TO SPEEDY PUBLIC TRIAL BY A JURY; JURORS
ARE SELECTED FOR THEIR LACK OF BIAS
*YOU MUST BE TOLD OF CHARGES
*YOU MUST BE PROVIDED A LAWYER IF YOU CANNOT
AFFORD ONE, KNOWN AS HAVING RIGHT TO LEGAL
COUNSEL
7th Amendment
YOU HAVE THE RIGHT TO SUE SOMEONE IN A CIVIL CASE IN COURT, AND HAVE A TRIAL BY
JURY, WHEN THE VALUE IN THE ARGUMENT IS MORE THAN $20. HOWEVER THESE TYPES OF CASES ARE USUALLY NOT HEARD IN THE FEDERAL COURT SYSTEM.
8th Amendment
*NO EXCESSIVE BAIL
*NO CRUEL AND UNUSUAL
PUNISHMENT
9th Amendment
CITIZENS HAVE UNENUMERATED
RIGHTS (THOSE RIGHTS NOT
SPECIFICALLY LISTED IN THE
CONSTITUTION) AND THE FACT THAT THE FIRST 8 AMENDMENTS TO THE CONSTITUTION ARE NOT THE ONLY RIGHTS THAT THE PEOPLE HAVE
10th Amendment
POWERS NOT IN THE CONSTITUTION, OR FORBIDDEN, ARE GIVEN TO THE STATES OR THE PEOPLE
What do the first 4 amendments have in common?
They PROTECT CITIZENS from possible abuses by the federal government.
What do amendments 5-8 have in common?
They PROTECT PEOPLE who are ACCUSED OF CRIMES.
What do amendments 9 & 10 have in common?
They give power to the PEOPLE and the STATES. (limit the power of the federal government)
