A defendant will qualify for legal aid if they come within at least one of the five ‘interests of justice’ factors, which are ?
If found guilty the defendant would likely loose their way of livelihood
the case involves a point of law
the defendant is unable to understand the court proceedings or is unable to state their own case
the case involves expert cross examination of witnesses
it is in the interests of another person that he individual be represented
what is the means test ?
If under the age of 16, under 18 and in full time education, on income support automatically pass the test for free legal aid after which under a certain amount of GAI means you get free legal aid
