use of force may be necessary to:
stop dangerous and unlawful behaviour
Protect the police member, or another person, from injury
Protect the person from self injury
Overcome resistance to a lawful arrest
prevent escape of a suspect
Prevent destruction of evidence , or property
what are the two elements of the justified force doctrine
Escalation- The level of control used by police members is selected in response to the level of resistance offered by the person
Preclusion- police members may “rule out” lower control options if they believe the selected level of force would be innefective or innapropriate for the circumstances. this means it is not necessary to progress from one level to the next until control is gained.
Six levels of the resisitance continum:
Psychological intimidation
verbal non-compliance
passive resistance
defensive resistance
Active aggression
Aggravated active aggression
threat assessment:
Weapon- the person must have a weapon
Intent- a persons behaviour must indicate their intention to use a weapon against a police member. or another person. This is based on the reasonbable belief of the police member using force.
Delivery System- the weapon is in play and can be used from the persons current position.
Six levels of the Control Continuum:
Police officer presence
Verbal direction
Soft-Empty hand Control
Hard Empty hand control
Intermediate weapons
Lethal force
Intentional strikes with impact weapons such as (give 5 examples) are considered lethal force:
head, neck, clavicles, spine, and groin
What is the One plus One doctrine:
stipulates that police meners have the right to select one level of control higher than the level of resistance used by a person
police members must be able to articulate that they did not have the skill, or time, to safely engage and control a person using equal force used by the person.
factors to consider are:
- Age disparity
- Strength Disparity
- Size disparity
- Skill disparity
- Number of Police members (raito)
