What is hate?
Connotes intense and extreme emotion
associated with vilification and detestation
Implies that those individuals are to be despised, scorned, denied respect and
made subject of ill-treatment
insufficient that the msg is offensive, disliked or unwelcomed
What is a hate crime?
Any criminal offence against a person or property motivated by the suspect’s hate, prejudice or bias against an identifiable group
what are some hate crime Categories?
Hate propoganda Offences
Mischief Offences
Any other offence Motivated by hate or bias where the sentencing judge must consider the actions of the offender as an aggravated factor
Hate Propoganda Offences:
318: Advocating Genocide
319(1) Public incitement of hatred (stirring up hatred in a public place)
319(2) Willful promotion of hatred
Hateful mischief:
430(4.1) Mischief in relation to property:
Used for religous worship
Used as educational institutions
Used for social, cultural, or sports activities or events
Used as a seniors residence
What does GP do when we have something criminal (Hate Crime wise)
Take report
Investigate and submit report and ensure it is flagged as a hate Crime
Task Hate Crime Unit
Submit non-criminal incidents
Notify Victim services
Contact IDENT
Indicate Crt Assisstance Report
Consult Co-ordinator if required
What does GP do in noncriminal Hate incidents?
Submit a report if complainant wishes for info purposes
ensure the report is flagged as Hate Crime
Refer complainants to:
- Human right and Civil Rights Protection
- MB Departement of labour and Immigration, Multiculterism Secretariat
